1.1 Pursuant to Section 684(1)(13) of the Local Government Act 1974, the Local Government Act 2002 and Land Transport Rule: Setting of Speed Limits 2003 the Hastings District Council makes this bylaw to set speed limits as specified in the schedules.
2.1 The title of this bylaw is the Hastings District Council Draft Speed Limits Bylaw 2009, being part 10 of the Hastings District Council Bylaws.
3.1 So far as they are applicable, and are not contrary to the provisions of this bylaw, the provisions of the introductory bylaw 2005 are incorporated into and form part of this bylaw.
4.1 The speed limits described in the schedules come into force on the date specified in the schedules.
5.1 Holiday Speed Limit, Road, Speed limit, Temporary Speed Limit, Rural area, Urban traffic area and Urban Speed limit all have the meanings ascribed to them in the Land Transport Rule: Setting of Speed Limits 2003
5.2 Speed Limit for a Road in a Designated Location means a speed limit for vehicle traffic imposed by the Council pursuant to clauses 7.1 and 7.2 of this bylaw.
6.1 The roads or areas described in the schedules specified in paragraph 9 or as shown on a map referenced in the schedules, (and attached to this Bylaw) are declared to have the speed limits specified in those schedules and maps, which are part of this bylaw.
6.2 The Council may by resolution in accordance with clauses 7.1 and 7.2 make additions to or, alterations to, bylaw speed limits for any roads or areas identified in the schedules.
6.3 The Council may by resolution in accordance with clauses 7.1 and 7.2 of this bylaw, make or alter bylaw speed limits in any of the following Designated Locations:
(a) a carpark
(b) an educational or scientific institution
(c) a health facility
(d) a residential facility
(e) a camping ground
(f) a sports facility or other recreational area
(g) a botanical garden
(h) a port or wharf area
(i) an airport
(j) a beach
(k) a cemetery
(l) a reserve as defined in part 15 of the Hastings District Council bylaws
(m) a facility operated by the New Zealand Defence Force
(n) any other location approved by the Director of Land Transport Safety
6.4 Council may by resolution in accordance with clauses 7.1 and 7.2 also set holiday speed limits and temporary speed limits.
6.5 From the date the various speed limits in the schedules in this bylaw come into force and until the Council by resolution in accordance with clauses 7.1 and 7.2 alters the same the speed limit (being a Speed Limit for a Designated Location) in or on all reserves, beaches and cemeteries within the Hastings District shall be 20km/hour.
7.1 If the Council chooses to create, amend or alter any bylaw speed limit by way of resolution under clause 6.2 of this bylaw, the special consultative procedure set out in section 83 Local Government Act 2002 will be followed.
7.2 Where the Council intends to pass a resolution under clause 6.2 of this bylaw to set a speed limit for a particular road or area, then in addition to the requirements of section 83 Local Government Act the Council will also write to all relevant landowners and occupiers of property on the affected portion of road giving them the opportunity to submit and be heard.
8.0 Offences
8.1 Every person commits an offence against this Bylaw who operates a vehicle in excess of the bylaw speed limits set by this bylaw.

10. 0 Date bylaw made
10.1 This bylaw was made by the Hastings District Council at a meeting of the Council on 18 June 2009.
Schedule 1 is not used in this bylaw.
