The Environment Court Hearing was held on 13 - 15 November 2006. At the hearing Progressive’s sought that ‘supermarkets’ be provided for as a restricted discretionary activity in the Mega Centre Zone.

Foodstuffs opposed this appeal and sought the retention of the Independent Hearings Commissioners decision of having supermarkets as a non-complying activity in the Mega Centre Zone and a restricted discretionary activity in the Large Format Retail Zone.

The Hastings District Council chose to support the Progressive’s appeal to enable supermarkets to be provided for in the Mega Centre Zone, and to also seek a consequential amendment to simplify the Plan provisions by merging the Mega Centre Zone into a single Large Format Retail Zoning.

The Environment Court decision (see link below) was to allow Progressive’s appeal and the consequential amendments sought by Council. As a result of this decision the Hastings District Council has declared Plan Change 21 operative as of 26 February 2007.

Original reasons for Plan Change 21

Hastings' Central Business District boundaries were last defined 15 years ago, but shopping isn't what it used to be. Seven day openings and large format retail stores have changed the face and pace of how we shop.

The Hastings District Council has developed and adopted a strategy to manage the future development of the retail sector for the betterment of the Hastings Central Business District and wider District.

This includes accommodating the needs of large format retail while minimising damage to the Central Business District's character. As part of the implementation of the Commercial Zone Review and Large Format Retailing Strategy 2003 – 2023, a number of changes to the Hastings District Plan are proposed.

The proposed Plan Change includes changes to the planning maps, rules, objectives and policies of the Hastings District Plan.

Implementing the retail strategy involves rezoning a total of 20 hectares of land, as an expansion of the existing Hastings central commercial area, to consolidate and manage the effects associated with large format retail developments. The proposed plan change relates to land bounded by Caroline Road (part of which is to be stopped), Alexandra Crescent, Alexandra Street, Warren Street North, Victoria Street, Hastings Street North and St Aubyn Street.

The proposed plan change involves:

  • The proposed creation of two new zones a Large Format Retail and Mega Centre Zone (PDF, 346 KB)
  • The introduction of environmental controls, for example, landscaping and location of buildings from boundaries on developments;
  • The adjustment of existing commercial and retail zone boundaries; and
  • The introduction of other controls in line with the strategic actions, goals and objectives of the Commercial Zone Review and Large Format Retail Strategy .
