Plan Change 28

Plan Change 28 introduces new provisions and rules in the District Plan to consider the potential risks from historical persistent chemical residues when land is developed for residential purposes.

The proposed Plan Change is a key step in making soil testing a requirement of subdivision and rezoning applications particularly where the potential risk of historic agrichemical use may affect human health.

The Plan Change results in response to existing pressure for development of former horticultural land within the Hastings District. There is the urgent need to address the issue in light of current subdivision applications to consider the potential risks of historical persistent chemical residues to future residents.

The proposed Plan Change introduces new provisions, rules and performance standards to the Subdivision and Land Development Section as well as other relevant sections of the Plan to consider potential adverse effects posed by historical persistent chemical residues in soils.

Plan Change 28 was publicly notified on the 9 April 2005, along with the related Section 32 Analysis.

The closing date for submissions was 9 May 2005. A total of nine (9) submissions were received.

The summary of submissions was publicly notified and further submissions were called for on 28 May 2005 with the closing date for further submissions being 27 June 2005.

A total of seventeen (17) further submissions were received .

The hearing of submissions was held on 17 and 18 September 2005.

Council’s final decision was publicly notified on 4 November 2005.

Environment Court Appeal

Horticulture New Zealand (formally known as Vegfed) has appealed Council's decision to the Environment Court. Five other submitters to the Plan Change registered as ‘interested parties (section 274 RMA)’ to the Appeal. Mediation in attempting to resolve the appeal out of court is currently in progress.
