Plan Change 31

Mr John Hayes and the Estate R A Hayes (the applicant) sought a Plan Change to rezone land from Rural to Coastal Residential. The area of land to be rezoned comprises 3.9 hectares within a site of 28.4248 hectares and legally described as: Section 21 and Part Section 19 Survey Office Plan 2255 Section 35 Survey Office Plan 6560 (CT HBM3/1394).

The plan change request was originally received in 2004 and notified for submissions in 2005.  The hearing of submissions was delayed however after the release of the Te Ngaru Catchment Flood Hazard study by the Hawke’s Bay Regional Council in September 2005.

Further information was submitted by the requestor to mitigate the flood hazard in 2007.  The Plan Change was subsequently renotified for submissions with a submission hearing being held in May 2008.  Plan Change 31 was approved with modifications and no appeals were received on the decision. 

Plan Change 31 became an operative part of the Hastings District Plan on 6 October 2008.

Background Information

The area subject to Plan Change 31 is located at the end of Tangoio road. It encompasses all the landward baches in the existing bach settlement at Tangoio beach and further land behind these baches fronting the road.

The rezoning will facilitate coastal residential development on part of the site identified as the ‘Tangoio Plan Change Area’ below.

This plan change application was previously notified in March 2005 but did not proceed to the Hearing that was scheduled for June 2007.
