Proposed changes to the District Plan

This Plan Change is subject to Clause 5 of the First Schedule of the Resource Management Act 1991 and proposes changes to the following sections of the Operative Hastings District Plan.

  1. Section 15.1 Subdivision and Land Development
  2. Section 18.0 Definitions
  3. District Plan Maps

This plan change amends the District Plan’s definition of the Coastal Environment so that it is consistent with the Coastal Environment as defined in the Proposed Regional Coastal Environment Plan.

Plan Change 38 also adds provisions to the District Plan which make all subdivisions occurring within the Coastal Environment where located in the Rural Zone, Discretionary Activities.

Background to Plan Change 38

The growing demand for coastal property and continued development pressure within the District has led to increased concern with respect to how the District Plan currently deals with the subdivision of rural zoned land within the District’s Coastal Environment.

Plan Change 38 arises from such concerns and also as a result of recent applications being made to Council seeking to subdivide multiple 20 hectare rural zoned sites for lifestyle purposes along the District’s Coast.

Community concerns coupled with the above mentioned applications have highlighted deficiencies in the existing plan provisions. This is particularly with respect to the ‘preservation of the natural character of the coastal environment’ and protecting it from ‘inappropriate subdivision and development’, as Council is required to do by the New Zealand Coastal Policy Statement and Resource Management Act respectively.

Plan Change 38 seeks to provide District Plan provisions that ensure that subdivision, use and development does not detract from or compromise those natural and physical features which afford the District’s rural zoned coastal environment its natural character value.

Plan Change 38 forms part of the District Plan rolling review which is required by the Act. The plan change also seeks to address some of the identified deficiencies in the District Plan which contribute to the overall effectiveness and efficiency of the District Plan and the ability of the Plan to achieve the desired community environmental outcomes.

Further submissions

The closing date for further submissions was 4.30pm Friday 18th July 2008.

Appeal

An appeal against this decision was received on 9 December 2008.

This appeal was withdrawn and the Plan Change declared operative on November 30 2009.
