Plan Change 43

This Plan Change was heard by independent commissioners (Alan Watson and Terry Brown) on 3 & 4 March 2008.

The commissioners recommended approval of the Plan Change with modifications (for Council initiated Plan Changes commissioners make recommendations to Council who make the final decision).

These recommendations were adopted in full by Council with its decision being notified on 25 August 2008.

This decision has subsequently been appealed and the Plan Change is now in the Environment Court appeal process.

Summary

The Hastings District Council notified Plan Change 43. Proposed Plan Change 43 seeks to rezone approximately 7150m2 of land from Plains Zone to General Residential (via a Deferred Residential Zoning) at the eastern end of Jellicoe Street and Jubilee Street in Hastings.

The proposed rezoned area would extend to the edge of the Proposed Hastings Northern Arterial Route “NAR” which is being notified concurrently with this proposed Plan Change.

Plan Change 43 proposes changes to the planning maps and rules of the Hastings District Plan as follows:

  • Amend planning maps 18a and 56a of the Hastings District Plan, so that the land immediately adjacent to the end of Jellicoe Street and Jubilee Street is rezoned from Plains Zone to General Residential Zone (via a Deferred Residential Zoning); and
  • Insert a new provision under Rule 8.7.2.1 to state that the Deferred Residential Zoning immediately adjacent to the end of Jellicoe Street and Jubilee Street will cease to have effect when the noise fence associated with the Proposed Hastings Northern Arterial Route (NAR) is constructed.

Submissions

The closing date for lodging a submission was Wednesday 19th December 2007.

A total of six (6) submissions were received and further submissions can now be lodged either in support or opposition to any submission received.

Further submissions

Further submissions closed on 25th February 2008.

A total of ten further submissions were received.

Hearing

  • 9.00am Monday, 14 April through to 16 April 2008
  • No hearing on 17 April
  • Continues 9.00am Friday, 18 April 2008, then Monday 21 April through to 24 April 2008.

Public Participation Process

The process for public participation in the consideration of the proposed plan change under the Act is as follows:

  • after the closing date for submissions, Hastings District Council must prepare a summary of the submissions and this summary must be publicly notified; and
  • there must be an opportunity to make a further submission in support of, or in opposition to, the submissions already made; and
  • if a person making a submission asks to be heard in support of his or her submission, a hearing must be held; and
  • Hastings District Council must give its decision on the proposal (including its reasons for accepting or rejecting submissions); and
  • any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court.
