Plan Change 44

Decision

The Hearing of this private plan change and submissions to it was held from 21 – 25 July 2008. The Hearings Committee’s decision to decline the application was released on 8 August 2008.

This decision was subsequently appealed but the appeal was withdrawn in October 2008.

Summary

Hastings District Council has received a request from Amnico Village Holdings Ltd for a change to the Hastings District Plan referred to as Proposed Plan Change 44: Brookvale Road Retirement Village.

Proposed Plan Change 44 seeks to rezone approximately 18.279 hectares of land in the block bounded by Romanes Drive, Brookvale Road, and Thompson Rd, from Plains Zone to General Residential for the specific purpose of establishing a Retirement Village and activities in accordance with the Brookvale Road Retirement Village Concept Plan.

The concept plan proposes approximately 369 accommodation units and a commercial node containing a village centre, childcare centre and serviced apartments.

The request also seeks to rezone an abutting 9775m2 of the subject land on Brookvale Road to Deferred General Residential (which is proposed to become ‘General Residential’ on 1 December 2010).

Proposed Plan Change 44 proposes changes to the planning maps and rules of the Hastings District Plan as follows:

  • Amends Planning Map 64a by rezoning the subject land from Plains to General Residential and Deferred Residential.
  • Introduces a new Concept Plan for the ‘Brookvale Road Retirement Village’ as Appendix 8.0-6 to the Residential Section of the District Plan.
  • Provides for the Retirement Village and Associated Activities in accordance with the Concept Plan in Appendix 8.0-6 as permitted activities in the General Residential Zone.
  • Provides for any Variation to the Concept Plan in Appendix 8.0-6 as a restricted discretionary activity.
  • Amends Section 8.7.2.1 (Deferred Residential Zone) by specifying the area adjacent to the intersections of Brookvale Road and Romanes Drive will become General Residential on 1 December 2010.
  • Amends Standards for Landscaping, Screening, Visual Amenity, and Traffic Generation to apply to those shown on the Concept Plan in Appendix 8.0-6.
  • Amends Assessment Criteria 8.13 by adding a clause relating to contaminated soils mitigating measures’.

Submissions

The closing date for lodging a submission was Friday 25th January 2008.

A total of thirty eight (38) submissions were received and further submissions can now be lodged either in support or opposition to any submission received.

Further Submissions closed on 28 March 2008.

Public Participation Process

The process for public participation in the consideration of the proposed plan change under the Act is as follows:

  • after the closing date for submissions, Hastings District Council must prepare a summary of the submissions and this summary must be publicly notified; and
  • there must be an opportunity to make a further submission in support of, or in opposition to, the submissions already made; and
  • if a person making a submission asks to be heard in support of his or her submission, a hearing must be held; and
  • Hastings District Council must give its decision on the proposal (including its reasons for accepting or rejecting submissions); and
  • any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court.
