Plan Change 45

The Hastings District Council received a request from Hill Country Corporation Limited (HCCL) to change the Hastings District Plan in May 2007. This private plan change request is referred to as Private Plan Change 45: Ocean Beach Special Character Zone.

On 17 October 2008 notice was received from HCCL that they wished to withdraw the plan change.

On 4 November 2008 the Hastings District Council received a report responding to the HCCL notice of withdrawal. At this meeting Council resolved to publicly notify that Private Plan Change 45 has been withdrawn.

The following provides a background to the plan change that was requested and a summary of events, including the submissions and further submissions received, up to the point of withdrawal of Private Plan Change 45.

Summary of the application

In summary, the HCCL request seeks to rezone some 950 hectares of land contained in a total of 13 existing separate Certificates of Title at Ocean Beach, from Rural Zone to Ocean Beach Special Character Zone.

This zoning seeks to provide a framework to enable the development of a new village at the southern end of the beach and to provide for ecological restoration and conservation at the northern end of the beach and for the continuation of farming operations, including provision for equestrian activities and associated clustered housing, on the land in between.

The proposed Ocean Beach Special Character Zone incorporates a number of ‘sub zones’ including Residential (which includes 3 sub zonings with varying levels of residential density), Village Centre, Commercial Service, Rural, Rural Equestrian (with provision for cluster housing) and Rural Conservation (the area contained within the predator proof fence).

Submissions closed on 29 February 2008, with a total of 208 submissions received. A summary of submissions has now been prepared. To view the submissions and summary of submissions, see the heading Submissions below.

A hearing had been tentatively scheduled to commence on 28 October 2008, this was then postponed at the request of HCCL to be rescheduled after March 2009 (dates to be confirmed).

A panel of 4 independent commissioners had been appointed to conduct the hearing, The panel consisted of Doug Arcus (Chair with a casting vote), Alan Watson, Rauru Kirikiri and Mary Buckland. The commissioners appointed were all accredited by the Ministry for the Environment. The further submission process does not allow for new submissions to be made, but allows people the opportunity to support or oppose original submissions. A total of 11 further submissions were received and can be viewed from the links below.

Public particpation

The process for public participation in the consideration of the proposed plan change under the Act is as follows:

  • after the closing date for submissions, Hastings District Council must prepare a summary of the submissions and this summary must be publicly notified; and
  • there must be an opportunity to make a further submission in support of, or in opposition to, the submissions already made; and
  • if a person making a submission asks to be heard in support of his or her submission, a hearing must be held; and
  • Hastings District Council must give its decision on the proposal (including its reasons for accepting or rejecting submissions); and
  • any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court.
