Plan Changes : Proposed Plan Change 45 Ocean Beach Special Character Zone
Pursuant to Clause 5 of First Schedule, Resource Management Act 1991 the Hastings District Council advises that it has received a request from Hill Country Corporation Limited (HCCL) to change the Hastings District Plan. This private plan change request is referred to as Private Plan Change 45: Ocean Beach Special Character Zone.
In summary, the HCCL request seeks to rezone some 950 hectares of land contained in a total of 13 existing separate Certificates of Title at Ocean Beach, from Rural Zone to Ocean Beach Special Character Zone.
This zoning seeks to provide a framework to enable the development of a new village at the southern end of the beach and to provide for ecological restoration and conservation at the northern end of the beach and for the continuation of farming operations, including provision for equestrian activities and associated clustered housing, on the land in between.
The proposed Ocean Beach Special Character Zone incorporates a number of ‘sub zones’ including Residential (which includes 3 sub zonings with varying levels of residential density), Village Centre, Commercial Service, Rural, Rural Equestrian (with provision for cluster housing) and Rural Conservation (the area contained within the predator proof fence).
Submissions closed on 29 February 2008, with a total of 208 submissions received. A summary of submissions has now been prepared and further submissions are being received until 9th June 2008. For more details on lodging a further submission see the heading Further Submissions below.

The submissions have been grouped in alphabetical order by submitters' surnames or organisation names.
The ‘Index of Submitters’ names’ provides a useful reference for finding who made submissions and the submission numbers allocated. It also provides a general breakdown of numbers of submissions in support and opposition and the number of those submitters wishing to be heard.

Further submissions
The further submission process does not allow for new submissions to be made, but allows people the opportunity to support or oppose original submissions.
For example, where an original submission seeks specific changes to the provisions of the Plan Change applied for, further submissions can be made either supporting or opposing the changes sought.
The submissions have been summarised in accordance with Schedule 1 of the Resource Management Act 1991.

Public particpation
The process for public participation in the consideration of the proposed plan change under the Act is as follows:
- after the closing date for submissions, Hastings District Council must prepare a summary of the submissions and this summary must be publicly notified; and
- there must be an opportunity to make a further submission in support of, or in opposition to, the submissions already made; and
- if a person making a submission asks to be heard in support of his or her submission, a hearing must be held; and
- Hastings District Council must give its decision on the proposal (including its reasons for accepting or rejecting submissions); and
- any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court.
