Background

What are bylaws?
Bylaws are special laws that apply in Hastings District only. They deal with public nuisances, maintain public health and safety and governs offensive behaviour in public places. For example, the Liquor Control Bylaw directs the consumption and possession of liquor in specified public places to address criminal offending and public safety concerns.

How are bylaws enforced?
Bylaws are enforced by Council officers who have been appointed specifically for that purpose. These include Environmental Health Officers, Resource Management Officers and security personnel.

Breaches of bylaws can result in court-imposed fines, confiscations of equipment or court orders for various purposes.

How is Hastings District Council managing the review?
Council established a Bylaws Working Party to oversee the review, recommend changes to existing bylaws and the introduction of new bylaws.

There are 23 bylaws which need to be reviewed over the next three years. Council has prioritised the review depending on when each bylaw was last reviewed. Priority is given to matters of urgency that need addressing and whether any legal issues have arisen that affect the objective and proper enforcement of the bylaw.

Bylaw Review

Hastings District Council is proposing to adopt following bylaws under part 8 of the Local Government Act 2002. These proposals are now open to public consultation and Council is keen to from any person, group or business that would like to make a submission on the following proposed bylaws:
