Statutory Acknowledgements arise as part of the Treaty Claims Settlements process.
Statutory acknowledgements relate to specific areas of importance (referred to as statutory areas) to a claimant group. They recognise the cultural, spiritual, historical and traditional association of iwi and hapu with particular areas.
Statutory areas only apply to crown owned land, rivers, lakes, coastal or geographic features.
Council’s Obligations
Under Treaty Claim settlements there is an obligation on the Council to record statutory acknowledgements on its district plan. This information is attached for information purposes and does form part of the Plan.
The Council must provide a summary of any resource consent application for any activity that is within, adjacent to, or directly affecting a statutory area, to the trustees of the relevant Post Settlement Governance Entity.
Council is also required to have regard to the statutory acknowledgement when forming an opinion as to whether relevant iwi is adversely affected by a resource consent application.
